Terms of service.

The agreement between you and City Embroidery Ltd (trading as ProfitMuncher) when you use the service. Plain English where we can manage it; the sturdier paragraphs where we can't.

§ 01

Who's who

"We", "us", "ProfitMuncher" means City Embroidery Ltd, a company registered in Scotland (company number SC795815), with its registered office at 1 Craigswood Gate, Baillieston, Glasgow G69 7FD, United Kingdom. ProfitMuncher is a trading name of City Embroidery Ltd. "You" means the person or organisation using the service.

By signing up or using the service, you agree to these terms. If you don't agree, please don't use it.

§ 02

Your account

You are responsible for keeping your sign-in credentials safe and for everything that happens in your workshop. If you suspect someone else has access, email [email protected] immediately.

Accuracy

The details you provide at sign-up should be accurate, and you should keep them current — particularly billing details and tax information.

§ 03

Trial & subscription

Every plan starts with a 14-day free trial. A payment method is taken at sign-up, and your first charge happens only when the trial ends.

In plain English Cancel any time before day 15 and you won't be charged. If you cancel after billing has started, your account stays active until the end of the period you've paid for. You can cancel from the settings page — no calls, no forms.

Subscriptions renew automatically until cancelled. You can cancel, upgrade or downgrade from the settings page at any time.

§ 04

Fees & payments

Checkout and subscription billing are handled by Lemon Squeezy, LLC as merchant of record. When you subscribe, Lemon Squeezy processes your payment, applies any VAT or sales tax your billing country requires, and issues your payment receipts and invoices.

The plan price is what you pay. We charge 0% transaction fees on the sales you process through your storefronts — your payment provider (Stripe, PayPal, etc.) charges their own fees, but nothing flows to us per sale.

§ 05

Refunds

Not happy in your first two weeks as a paying customer? We offer a 14-day money-back guarantee on your first charge: email [email protected] within 14 days of that charge and we'll refund it in full, back to your original payment method via Lemon Squeezy.

Renewal charges follow the cancel-forward rule in § 03: cancel any time and your account stays active until the end of the period you've paid for. Nothing in this section limits your statutory rights.

§ 06

Service availability

ProfitMuncher is a product in live, active development. We ship improvements continuously — often several times a day — and deployments normally happen without advance notice. A typical deployment interrupts service for under a minute; occasionally maintenance or an urgent fix may take longer.

No online service can truthfully promise 100% uptime, and we don't. The service is provided "as available", without an uptime guarantee or service-level agreement. What we do commit to: we monitor the platform around the clock and treat outages as our first priority.

§ 07

Your content stays yours

Your products, photos, customer data and storefront content belong to you. We need a limited licence to host, display and back it up so the service works — that's the only thing we use it for.

§ 08

Acceptable use

Don't use the service to break the law, infringe someone else's rights, or harm others. The full list lives in our Acceptable Use policy.

§ 09

Liability & limits

To the extent allowed by law, we are not liable for indirect or consequential losses — including lost profits, lost sales or lost data caused by downtime — and our total liability is capped at the fees you've paid us in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be excluded by law.

§ 10

Changes to these terms

We may update these terms as the product evolves. If a change is material, we'll email registered users at least 14 days before it takes effect. Minor changes — clarifications, typo fixes, describing new features — take effect when posted on this page.

§ 11

Ending the agreement

You can cancel anytime. We can suspend or close accounts that breach these terms, but we'll give notice and a chance to fix it where reasonable. After cancellation, email [email protected] and we'll provide an export of your data.

§ 12

Governing law

These terms are governed by the law of Scotland. The Scottish courts have exclusive jurisdiction over any dispute.
